These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "You", "Your") and AGK CORRETORA DE CAMBIO S.A. ("AGK", "We", "Us", "Our"), a foreign exchange brokerage established under Brazilian law with its registered office at Rua Dr. Rafael de Barros, 209 - 9º andar, São Paulo - SP.
By accessing our website at www.agkcorretora-fn.it.com or using our foreign exchange services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our website or services.
Eligibility: To use our services, you must: (a) be at least 18 years old, (b) have legal capacity to enter into contracts, (c) provide accurate and complete information, and (d) comply with all applicable Brazilian laws and regulations.
AGK provides foreign exchange services including currency exchange, international wire transfers, import/export FX operations, pre-paid travel cards, and related advisory services. All services are subject to Central Bank of Brazil regulations and our internal policies.
You agree not to use our services for fraudulent or illegal activities, money laundering or terrorist financing, providing false or misleading information, attempting to gain unauthorised access to our systems, or any activity that violates Brazilian law or Central Bank regulations.
All applicable fees, exchange rate spreads, and charges will be disclosed before transaction execution. AGK reserves the right to adjust rates and fees based on market conditions. Client agrees to pay all applicable fees associated with their transactions.
To the maximum extent permitted by Brazilian law, AGK shall not be liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the value of the specific transaction giving rise to the claim. We are not responsible for delays caused by correspondent banks, payment networks, or circumstances beyond our reasonable control.
All content on our website, including text, graphics, logos, and software, is the property of AGK or our licensors and is protected by Brazilian intellectual property laws.
AGK is authorised and regulated by the Central Bank of Brazil. We comply with all applicable regulations including AML laws, KYC requirements, LGPD (data protection), and foreign exchange regulations (RMç 277/11 and amendments).
You may close your account by providing written notice. We reserve the right to suspend or close accounts at our discretion where required by law or where we suspect fraudulent or illegal activity.
These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved in the courts of São Paulo - SP, Brazil.
We may modify these Terms at any time. Changes will be posted on our website with the updated date. Continued use of our services after changes constitutes acceptance of the modified Terms.
